Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Cutie Nails mobile application and website (the "Service"), operated by Miramar Labs XYZ, LLC ("we," "us," or "our"). Please read these Terms carefully before using our Service.

By downloading, installing, or using Cutie Nails, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Cutie Nails. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Service on compatible devices that you own or control, solely for personal, non-commercial use.

4. Subscriptions and Payments

Cutie Nails is a subscription service. Downloading the app is free, but using it requires an active Cutie Nails Pro subscription. There is no free tier and no free usage allowance.

3-day free trial: New subscribers who have not previously subscribed are offered a 3-day free trial. At the end of the trial your subscription automatically converts to a paid subscription at the price shown at the time of purchase, unless you cancel at least 24 hours before the trial ends. If you have subscribed to Cutie Nails before, you are not eligible for the trial and will be charged the regular price from the start.

Pro subscription: A Pro subscription unlocks unlimited AI try-ons, every color, finish, shape and length, all designer nail art designs, AI suggestions, and saved looks. Subscriptions are offered on a monthly or annual basis and are billed through Apple's App Store.

5. Acceptable Use and Restrictions

You agree to use Cutie Nails only for lawful purposes and in a way that does not infringe the rights of others. You must not:

6. AI-Generated Results Disclaimer

You acknowledge that images generated or edited through AI features are computer-generated outputs and may not be fully accurate, reliable, or suitable for all purposes. We make no guarantees regarding the accuracy, completeness, realism, or fitness of AI-generated results.

You are solely responsible for how you use or rely on AI-generated outputs, including any sharing, publishing, or commercial use of those outputs.

7. Intellectual Property

All content, features, and functionality of Cutie Nails — including but not limited to the app design, nail style assets, AI models, text, graphics, logos, and software — are owned by Cutie Nails or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

8. User Content

If you upload, save, or share photos or other content through the Service ("User Content"), you retain ownership of that content. By submitting User Content, you grant us a worldwide, royalty-free, non-exclusive license to store, display, and process your User Content solely for the purpose of providing the Service to you.

You represent that your User Content does not violate any third-party rights and that you have all necessary permissions to submit it.

9. Camera and Image Processing

Cutie Nails uses your device's camera to provide try-on features. When you choose to submit a photo for AI rendering, that selected image is transmitted to our servers for processing. Camera access is requested only for app features that require it.

10. Privacy

Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated by reference into these Terms.

11. Third-Party Services

The Service integrates with third-party services including Firebase (Google), Apple App Store services, and RevenueCat. Your use of those services may also be subject to their own terms and privacy policies.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. The virtual nail try-on is an approximation — actual nail results may differ.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CUTIE NAILS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

14. Indemnification

You agree to defend, indemnify, and hold harmless Cutie Nails and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. You may terminate your account at any time by deleting the app and contacting us at support@miramarlabs.xyz.

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will do so, including Sections 5, 8, 9, and 10.

16. Export Compliance

You agree to comply with all applicable export control and sanctions laws and regulations in connection with your use of the Service.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws rules. Any legal action arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and you consent to that jurisdiction and venue.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

19. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

20. Entire Agreement

These Terms, together with our Privacy Policy and any additional policies incorporated by reference, constitute the entire agreement between you and Miramar Labs XYZ, LLC regarding the Service and supersede prior agreements regarding the same subject matter.

21. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via the app or email and update the "Last updated" date. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
