These Terms of Service ("Terms") govern your access to and use of the Cutie Nails mobile application and website (the "Service"), operated by Cutie Nails ("we," "us," or "our"). Please read these Terms carefully before using our Service.

By downloading, installing, or using Cutie Nails, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Cutie Nails. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms.

3. Subscriptions and Payments

Free tier: Cutie Nails offers a free tier with access to a selection of nail styles and colors, and up to 5 saved looks.

Pro subscription: Upgrading to Pro unlocks unlimited styles, colors, AI suggestions, and saved looks. Subscriptions are billed through Apple's App Store on a monthly or annual basis.

You agree to use Cutie Nails only for lawful purposes and in a way that does not infringe the rights of others. You must not:

5. Intellectual Property

All content, features, and functionality of Cutie Nails — including but not limited to the app design, nail style assets, AI models, text, graphics, logos, and software — are owned by Cutie Nails or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

6. User Content

If you upload, save, or share photos or other content through the Service ("User Content"), you retain ownership of that content. By submitting User Content, you grant us a worldwide, royalty-free, non-exclusive license to store, display, and process your User Content solely for the purpose of providing the Service to you.

You represent that your User Content does not violate any third-party rights and that you have all necessary permissions to submit it.

7. Camera and On-Device Processing

Cutie Nails uses your device's camera to provide the live nail try-on feature. Camera frames are processed entirely on-device and are not transmitted to our servers. You grant us permission to access your camera only while you are actively using the try-on feature.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. The virtual nail try-on is an approximation — actual nail results may differ.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CUTIE NAILS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

10. Indemnification

You agree to defend, indemnify, and hold harmless Cutie Nails and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

11. Third-Party Services

The Service integrates with third-party services including Firebase (Google) and Superwall. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third parties.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. You may terminate your account at any time by deleting the app and contacting us at support@cutienails.app.

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will do so, including Sections 5, 8, 9, and 10.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Los Angeles County, California.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via the app or email and update the "Last updated" date. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
